Multi-creditor restructuring for a Selangor manufacturer

Insolvency & Restructuring Advisory

Situation

A plastics manufacturer with four secured creditors and twelve unsecured suppliers was approaching a point where it could no longer service its obligations. Two creditors had indicated they were prepared to commence winding up proceedings.

Approach

A full financial assessment was conducted, followed by a written advisory identifying a scheme of arrangement under the Companies Act 2016 as the most workable path. The firm advised on negotiation strategy and the key terms of the proposed scheme.

Outcome

Creditor support for the scheme was secured. The company continued operating throughout the process. Winding up proceedings were withdrawn following the scheme approval. The restructuring was completed over approximately eleven months.

Pre-licence compliance review for a Johor construction group

Environmental & Sustainability Compliance

Situation

A construction group seeking to expand operations to include materials processing required a new class of operating licence. They were uncertain about their obligations under the scheduled waste regulations and EQA licensing requirements.

Approach

A three-week compliance review identified the applicable regulations, assessed the client's current operational procedures against those requirements, and produced a written report prioritising the items requiring attention before licence application.

Outcome

Five compliance items were identified and addressed prior to application. The licence was issued without conditions on the first submission. The client noted the report was also useful for internal team training on regulatory obligations.
